Subject: John Malone and HCTC

Hi Mark,
I understand that John Malone, who was MEC Chairman from 2003 to 2005, is once again leading DALPA.  As you may remember, John was committed to protecting the old defined benefit retirement plan, but was ousted in favor of the crowd that agreed to allow Delta to terminate the plan and permanently reduce the benefits of Delta pilot retirees.

It seems to me that the only way Delta will ever provide any additional relief or compensation to Delta pilot retirees is for ALPA to negotiate such relief.  I plan to email John and ask him about this, but thought I would first check with you to see if you were aware of any effort already underway for ALPA to seek compensation for the sacrifices of retirees as well as active pilots.

On another issue, you are probably already aware that the PBGC and IRS have issued instructions for claiming the HCTC.  One aspect that some may not be aware of is the fact that once you go on Medicare, you are not eligible for the HCTC yourself, but you can claim it for your spouse and dependents for a period of 24 months from the date you started Medicare if they are on COBRA.  Here are the links:

Editor: Doug, Great to hear from you and Happy New Year!.   By all means approach any and everybody who would look into our plight and advocate for it.  I know of no organized effort to win ALPA support for ANY help on our behalf.  I can tell you that my experience has led me to believe that the active group would not support negotiating capital spent on retirees behalf, as there has been unfortunately a bad view accepted about the retiree's situation.   That said if John or any fair minded individuals would seek fairness as to our situation I and I am sure thousands of us are all for it.  Go for it!  In that vein, let us know what John's response is. 

Share with Malone (or anyone else for that matter) our Delta Pilot Retiree’s story:  


The HCTC as it once again becomes active will impact a number of our guys that can use it or can file an amended return for last two years.  I will certainly pass along your info and thank you for it, and hope that our group will get the heads up needed.  (See the Insurance section above).
