Issues
of Disability and the D&S Trust payouts, look for them under this section
because in essence the trust is insurance.
Below
we continue the discussion began by Kevin Garrison in HL 158 concerning the

Overpayment
Mark,
I sent this to Bob Ober and group and he asked me to forward
my info directly to you. Below is what I sent to him about 2 hours ago. Hope
this helps.
I know I told you a year or two ago that I more or less had
the same problem. I was overpaid over $69,000 from the D&S Fund from the
year 2004 through 2008. I was to pay that off over four years time at a 0%
interest rate. The problem that I had with that was the money I would be paying
back I had already paid federal taxes on. So I had my accountant draft a letter
showing what my taxes would have been without the overpayment and what they
were with the overage. I then sent an appeal letter to the subcommittee along
with the document that my accountant had drawn up and asked that the total
amount that I owed be reduced by the federal taxes that I overpaid. They were
kind enough to do so and my overpayment was reduced from $69,000 to just a
little over $46,000. That also reduced my monthly payments to about half of
what they were. This information might be beneficial to this gentleman if in
fact he wasn't accidentally getting money from both the D&S and the PBGC.
If you have any questions, give me a call.
Dick
