Subject: 2007 1040X Claim (Whalen) - My Update & Conclusions, so far..

Update

2007 1040X and 843 Claims (Whalen) - My experiences so far:

1) I filed all 2007 1040X's, 843's, etc., in November 2011 to the Fresno & St. Paul offices..

2) Then, I was audited by the IRS Bloomington, MN, office in December 2011..No audit, no disallowance or refund from State of Minnesota yet.

3) Personally I met numerous times with the IRS agent, no representation, but was advised each step of the way by Merrily Whalen whose advice & support have been invaluable.

4) IRS concluded with Full Disallowance of my claims.

5) Today, 8/17/2012, I personally met with the IRS agent & presented my 29-page Letter of Appeal in accordance with IRS pub. "Your Appeal Rights.."

Upon good advice from Merrily and Fairmark , I did not sign forms 4549, 3363, or 2297 as agent had requested I do as a result of disallowance of my claim.

6) Next, I will hear from the IRS Appeals Office. No date certain on this.

Conclusions

1) Some of us have been successful, some have not, in receiving refunds. Each IRS office appears to be autonomous.

One's decision does not set precedent for the others.

2) Once money from a claim is received, it should not be recalled or challenged by the IRS.

3) It is important to go through all the processes including audits, meetings, appeals, etc., to a conclusion. All processes are clearly defined in IRS publications.

I understand that I will have 2 years to file suit in court after the date I receive the Appeals Office's written decision.

4) Finally, I learned that there are court cases now being heard of plaintiff appeals regarding the disallowances of 2007 1040X and 843 claims.

It is vitally important to discover, to be aware of, and to remain current on any settlements in favor of the plaintiffs so we can file "New Information" amended returns.

I suggest that we all do our best to discover court case rulings in our favor & to keep PCN & Dick Deeds current with our updates for timely dissemination to our retired pilot group.

Subject: DD 214 Increased Social Security Benefits For Vets

Hello all,

This is going around again so I'm passing it along. The information below explains increased Social Security benefits if you served in the Military any time between 1957 and 2001. There is a link to the Social Security website that provides additional info. Looks to be good stuff so please do take the time to read it.

DD FORM 214 -- EXTRA SOCIAL SECURITY BENEFIT
for those with active duty between January 1957 to December 31, 2001

See the web site & notes below to possibly increase your Social Security Benefits.

Please share this with anyone who had active duty service between January 1957 to December 31, 2001, and planning for retirement. In a nutshell it boils down to this: You qualify for a higher social security payment because of your Military service, for active duty any time from 1957 through 2001 (the program was done away with 1 January 2002).

Up to $1200 per year of earnings credit credited at time of application - which can make a substantial difference in social security monthly payments upon your retirement.
You must bring your DD-214 to the Social Security Office and you must ask for this benefit to receive it!

This is something to put in your files for when you apply for Social Security down the road.. It is NOT just for retirees, BUT anyone who has served on active duty between January 1957 to December 31, 2001.

This benefit is not automatic, you must ASK for it...!!!
